TERMS & CONDITIONS

1.1. The promoter is Unilever South Africa (Pty) Ltd (“the Promoter”).

1.2. The Promotion is open to all South African Residents above the age of 18 who are in possession of a valid identity document or passport. The Promoter, its agents and distributors accept no liability whatsoever for the misuse of the reward voucher and or products, and are not liable for any personal loss, injury or death at Reward Partner featured venues and or by using the products, and cannot be held responsible for any dissatisfaction concerning quality or availability of featured venues and or products.

1.3. The promotional competition is not open to any director, member, partner, employee, agent or consultant of the Promoter, the marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members.

1.4. Any participant under the age of 18 years must be fully assisted by his/her guardian, who approves of and consents to the participant’s participation in the competition and the participant’s receipt/possession of the prize.

1.5. By participating in this competition participants agree to receive future marketing material from the brand/s on promotion. However, the participant has the right to unsubscribe to receiving marketing material or request the promoter to delete their information by contacting the Promoter at 15 Nollsworth Crescent, Nollsworth Park, La Lucia, 4051 Att: Legal Department or opting out from any electronic marketing message.

1.6. All personal information (‘Personal Data’) supplied by participants shall be processed in accordance with South African data protection legislation and the Promoter’s Privacy Policy.

1.7. This promotional competition is open from 15th November 2018 and ends at on 28th February 2019. Any entries received after midnight on the last day will not be valid and will not be considered.

1.8. The Promoter reserves the right, in its sole discretion and to the extent permitted by law, to amend these T&C’s at any time. The Promoter may notify The Participant of any significant changes, however there is no obligation on The Promoter to do so and it remains your responsibility to check these T&C’s regularly on the website and/or any other communications’ medium applicable.

1.9. The Promoter shall have the right to terminate the Promotion (“Termination”) immediately and without notice for any reason, beyond its control, requiring this. In the event of such Termination, The Participant agree to waive any rights that The Participant may have in terms of this Promotion and acknowledge that The Participant will have no recourse against the Promoter, its agents and/or staff.

 

GENERAL TERMS & CONDITIONS CONTINUED

1.10. These T&C’s constitute an agreement between The Promoter and the Participant ("The Participant").

1.11. These T&C’s as well as the terms of use governing each of the specific rewards/prizes/ benefits (“Rewards”) will apply to your participation/submission/entry (“Participation”) into the Promotion. Please note that these T&C’s do not replace the terms and conditions prescribed by each reward partner (“Reward Terms”) and must be read in conjunction with such other Reward Terms. It is your responsibility to familiarise yourself with those Rewards Terms.

1.12. By entering the Promotion, The Participant confirms that they have read, understood and agree to be bound by these T&C’s, as they may be amended from time to time. By continuing your Participation and use of the Rewards, after the Promoter has modified and/or amended these T&C’s, The Participant agrees to be bound by such modified T&C’s. If the modified T&C’s are not acceptable to The Participant, The Participant must terminate their Participation.

1.13. The offer is subject to promotional availability. Participating Reward Partner venues reserve the right to vary times and offer availability (e.g. Public holidays).

1.14. To the extent allowed by law, these T&C’s set out the whole of the agreement between The Participant and The Promoter in regard to the subject matter hereof and there are no other agreements, guarantees or representations, either verbal or in writing, in regard thereto upon which The Participant are relying in concluding this agreement and The Promoter shall not be bound by any express or implied term, representation, warranty, promise or the like not recorded herein.

This clause constitutes an acknowledgment of fact by The Participant. The Participant must ensure that The Participant reads the above clause carefully and ensure that this statement is true and correct as this will limit your rights to claim that these statements are not true and correct.

1.15. To the extent allowed by law, no extension of time or indulgence which The Promoter may grant to The Participant shall constitute a waiver of any of The Promoter's rights, who shall not thereby by precluded from exercising any rights against The Participant which may have arisen in the past or which might arise in the future. This clause limits and excludes obligations, liabilities and legal responsibilities which The Promoter will have towards The Participant and also limits and excludes your rights and remedies and places various risks, liabilities, obligations and legal responsibilities on The Participant.

1.16. These T&C’s shall be governed by and interpreted according to the laws of the Republic of South Africa and the parties consent to the non-exclusive jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town, in respect of any proceedings arising out of or in connection with these T&C’s.

1.17. Any provision in these T&C’s which is or may become illegal, invalid or unenforceable shall, to the extent of such prohibition or unenforceability, be ineffective and treated as having not been written and severed from the balance of these T&C’s, without invalidating the remaining provisions of these T&C’s

1.18. The Promoter and its agencies reserve the right to correct any errors and omissions. These terms and conditions will supersede any errors or omissions on any publicly communicated documentation or marketing material.

1.19. The Participant agrees that The Promoter may send any notice or notification arising under and/or contemplated in these T&C’s by electronic mail or other electronic communication to your contact details provided when The Participant subscribed to The Promoter.

1.20. The Participant are required to adhere to any South African Tax Laws linked to Rewards. It is your responsibility as a Participant to adhere and do the necessary submission is and when applicable.

 

2. ENTRY REQUIRMENTS

2.1. To enter, participants will be required to purchase 1 (one) participating OMO Novak product (All sizes of OMO Auto Liquid, Powder, 3 x Powder Capsule, OMO with Comfort Liquid & OMO with Comfort Powder) from participating stores during the promotional period. Participants must dial into the dedicated USSD string, *120*8937# (USSD costs 20 cents per 20 seconds. Free SMSs and minutes do not apply), to enter.

2.2. Upon entry, the Participant will be prompted to answer a series of questions. All questions must be answer in order to be eligible to win a reward.

2.3. The Participant will be informed on the USSD string whether they are a winner or not.

2.4. Winning participants will receive an SMS with a second USSD string, a unique winning pin code and instructions on how to redeem their reward. Rewards are predetermined by the system.

2.5. Once the reward voucher has been redeemed, the digital voucher will be sent to the winner via SMS.

2.6. Participants must keep their till slip as proof of purchase.

2.7. A participant will be limited to two (2) entries per month with a maximum of five (5) entries over the campaign period.

2.9. All Prizes must be pulled off the reward USSD string by 7th March 2019. Any Prizes not pulled off the system by 7th March 2019 will be forfeited.

2.10.  All Prizes are not exchangeable for cash or transferable.

 

3. SELECTING WINNERS

3.1. Winners will be randomly selected by via an automated process on the USSD String.

3.2. The Winners of the grand prizes will be required to provide their name, and may be required to provide their ID number, a copy of their identity document, contact details and to sign an acknowledgment of receipt of the prize. 

 

4. DELIVERY OF GRAND PRIZES

4.1. The Grand Prize includes delivery and the Winner will be required to provide the Promoter with a valid day time delivery address to enable delivery

 

5. PRIZE DETAILS

5.1. Only the owner of the MSDISN used to enter the promotion will be able to redeem the reward.

5.2. The Promoter and its agencies have the right to reject any participant suspected of fraudulent behaviour.

5.3. Photocopied, illegible or defaced vouchers will not be accepted.

5.4. Prizes may only be redeemed by the participant who entered the promotion and the reward is not transferable, for sale or re-sale, or redeemable for cash under any circumstance.

5.5. Data charges, required for any download and/or use of a reward/benefit, are never included.

These charges are for the participant’s own account.

5.6. The reward and/or voucher is not exchangeable for cash or for sale.

5.7. Participating Reward Partner venues and suppliers are all contracted to participate in the Promotion. The Promoter, its agents and distributors cannot be held responsible for any subsequently declining acceptance of the Reward and/or voucher for reasons of their own.

5.8. The Reward Voucher can only be used once.

5.9. The Reward Voucher cannot be used in conjunction with any other promotional offers.

5.10. The Promoter reserves the right to substitute any Reward for a Reward of the same or similar value.

5.11. All vouchers are governed the relevant terms and conditions supplied by the brand or store supplying the voucher.

 

6. TAKEALOT.COM COUPON

6.1. Only available for use on the Takealot.com website towards the purchase of products found on www.takelot.com.

6.2. Takealot.com Coupons are valid until 30 May 2019.

6.3. If a Takealot.com Coupon has not been used within that period, it will expire and be forfeited.

6.4. Coupons cannot be used to buy Gift Vouchers or other Coupons, and cannot be exchanged or refunded for cash or credit. Takealot is not responsible for any harm due to the loss, unauthorised use or distribution of a Coupon.

6.5. Takealot.com have the following conditions:

6.5.1. They can only be used once;

6.5.2. Only one Coupon can be used per order

6.5.3. A unique Coupon code can only be used once per promotion

6.5.4. Takelot.com Coupons may not be used in conjunction with any other reward, coupon, voucher or discount.

6.6. A Coupon must be used at check-out – it cannot be used later on existing orders.

6.7. The value of the Coupon will be set off against the value of your shopping basket, if the value of the basket is higher than the value of the coupon, you will be required to pay in the difference. If the value of the basket is less than the value of the coupon, you will forfeit the remaining value of the coupon.

6.8. Takelot.com Coupons do not accrue interest and are not refundable for cash once purchased.

6.9. Takealot.com is not responsible for any harm due to the loss, unauthorised use or unauthorised distribution of a Takealot.com coupon, after it has delivered the Takealot.com coupon to you or the email address nominated by you.

 

7. COL’CACCHIO VOUCHER

7.1. By purchasing, redeeming or attempting to redeem a voucher, you accept and agree to be bound by these Voucher Terms of Use and acknowledge you have read and understood these Voucher Terms of Use.

7.2. Col’Cacchio vouchers are valid until 31 December 2019.

7.3. Vouchers may not be used in conjunction with any other reward, voucher or discount.

7.4. Only one voucher can be used per bill.

7.5. The onus is on the participant to check the full voucher T&Cs issued with the voucher and to ensure they understand the voucher’s applications and limitations

7.6. Any fraudulent or abusive behaviour in order to benefit unduly from a voucher, is abuse of the benefit and Col'Cacchio reserves the right to cancel and not to honour any related vouchers.

7.7. The value of the voucher will be removed from the total value of the bill. Should the bill be less than the value of the bill, the participant will forfeit the remaining value of the voucher. Should the bill be higher than the value of the voucher, the participant will be required to pay in the difference.

7.8. Additional vouchers cannot be added to existing vouchers.

7.9. Vouchers are non-refundable and cannot be exchanged for cash.

7.10. Vouchers may be used at any Col’Cacchio store within South Africa and Namibia, unless specified.

 

8. NU METRO

8.1. Nu Metro vouchers are valid until 31 December 2019.

8.2. Each Nu Metro movie code is valid for 1 (one) regular priced 2D movie ticket.

8.3. Nu Metro code is valid on one purchase only.

8.4. The Nu Metro movie code can be used to purchase a ticket to a 2D movie from any Nu Metro channel (website, mobile App, self-service terminals, box office or catering counter).

8.5. The Nu Metro movie code is valid for 1 year from date of issue.

8.6. The 2D Nu Metro movie code is not valid at Bedford, Hyde Park, Parkview or Woodlands Nu Metro venues.

8.7. The 2D Nu Metro movie code is not valid for 3D, VIP, Xtreme or 4DX movies.

8.8. Regular Nu Metro terms and conditions apply.

 

9. SPUR DIGITAL VOUCHER

9.1. The Spur digital voucher may be utilised by the participant at any Restaurant as payment, or part payment (as the case may be) of the purchase price of goods ordered at such Restaurant (“the order”). The Spur digital voucher may also be used to pay a gratuity to a waitron (“the gratuity”). A maximum of 2 (Two) Spur digital voucher may be utilised as payment, or part payment (as the case may be), of the purchase price of an order and to pay any gratuity in respect of such order.

9.2. Spur vouchers are valid until 31 December 2019

9.3. Spur digital vouchers may not be refunded or exchanged for cash or credit.

9.4. The Participant will be required to:

9.4.1.    Write down the Unique Code which was smsed when settling the purchase price of such order and/or paying such gratuity; and.

9.4.2.    Indicate the portion of the purchase price of such order to be discharged utilising the Unique Code and/or the quantum of any gratuity that will be paid utilising the Digital gift voucher.

9.5. The value of the voucher will be removed from the total value of the bill. Should the bill be less than the value of the bill, the participant will forfeit the remaining value of the voucher. Should the bill be higher than the value of the voucher, the participant will be required to pay in the difference.

9.6. Should the Spur digital voucher be lost or stolen or misappropriated in any other manner whatsoever whilst in the possession of the Participant, neither Spur Group nor its franchisees(“the franchisees”) will be liable to the Purchaser or the Participant for any form of reimbursement or compensation of any nature whatsoever.

9.7. Misuse of the Spur digital voucher may constitute fraud and the Spur digital voucher may not be used for any unlawful purpose.

 

10. AIRTIME & DATA REWARD

 

11. CELL C

11.1. AIRTIME:

11.1.1. The airtime voucher entitles you to a (R10, R20, R50, R100) airtime voucher or network provider equivalent that can be used on a Cell C prepaid cell phone number

11.1.2. The airtime voucher can be used on any prepaid Cell C mobile number. Cell C contracts and any other networks are excluded

11.1.3. Airtime is active as it is loaded directly to prepaid MSISDN until it is depleted.

11.1.4. To load your airtime, dial *102* followed by the voucher pin in the voucher SMS and then #. e.g. *102*123456#. Your account will automatically be loaded onto your mobile number.

11.2. DATA:

11.2.1. The data voucher entitles you to a Cell C data voucher or network provider equivalent that can be used on a Cell C prepaid cell phone number.

11.2.2. The data voucher can be used on any prepaid Cell C mobile number. Cell C contracts and any other networks are excluded.

11.2.3. Data is valid for 30 (thirty) days once data is loaded.

11.2.4. To load your data, dial *102* followed by the voucher pin in the voucher SMS and then #. e.g. *102*123456#. Your account will automatically be loaded onto your mobile number.

 

12. MTN

12.1. AIRTIME:

12.1.1. The airtime voucher entitles you to a (R10, R20, R50, R100) airtime voucher or network provider equivalent that can be used on a MTN prepaid cell phone number

12.1.2. The airtime voucher can be used on any prepaid MTN mobile number. MTN contracts and any other networks are excluded

12.1.3. Airtime is active as it is loaded directly to prepaid MSISDN until it is depleted.

12.1.4. To load your airtime, dial *141* followed by the voucher pin in the voucher SMS and then #. e.g. *141*123456#. Your account will automatically be loaded onto your mobile number.

12.2.    DATA:

12.2.1. The data voucher entitles you to a MTN data voucher or network provider equivalent that can be used on a MTN prepaid cell phone number.

12.2.2. The data voucher can be used on any prepaid MTN mobile number. MTN contracts and any other networks are excluded.

12.2.3. R10 (ten rand) and R20 (twenty rand) data is valid for 30 (thirty) days once data is loaded. 

12.2.4. To load your data, dial *141* followed by the voucher pin in the voucher SMS and then #. e.g. *141*123456#. Your account will automatically be loaded onto your mobile number.

 

13. TELKOM MOBILE

13.1. AIRTIME:

13.1.1. The airtime voucher entitles you to a (R10, R20, R50, R100) airtime voucher or network provider equivalent that can be used on a Telkom mobile prepaid cell phone number

13.1.2. The airtime voucher can be used on any prepaid Telkom mobile number. Telkom mobile contracts and any other networks are excluded

13.1.3. Airtime is active as it is loaded directly to prepaid MSISDN until it is depleted.

13.1.4. To load your airtime, dial *188* followed by the voucher pin in the voucher SMS and then #. e.g. *188*123456#. Your account will automatically be loaded onto your mobile number.

13.2. DATA:

13.2.1. The Telkom data reward will be supplied in the form of airtime. To convert the Telkom (only) airtime to data, dial *180# and follow the prompts to choose the package.

13.2.2. The data voucher entitles you to a Telkom mobile data voucher or network provider equivalent that can be used on a Telkom mobile prepaid cell phone number.

13.2.3. The data voucher can be used on any prepaid Telkom mobile number. Telkom mobile contracts and any other networks are excluded.

13.2.4. Once converted, data validity is determined by the chosen package.

13.2.5. To load your data, dial *188* followed by the voucher pin in the voucher SMS and then

14. VODACOM

14.1. AIRTIME:

14.1.2. The airtime voucher can be used on any prepaid Telkom mobile number. Vodacom contracts and any other networks are excluded

14.1.3. Airtime is active as it is loaded directly to prepaid MSISDN until it is depleted.

14.1.4. To load your airtime, dial *100* followed by the voucher pin in the voucher SMS and then #. e.g. *100*123456#. Your account will automatically be loaded onto your mobile number.

14.2.    DATA:

14.2.1. The data voucher entitles you to a Vodacom data voucher or network provider equivalent that can be used on a Telkom mobile prepaid cell phone number.

14.2.2. The data voucher can be used on any prepaid Vodacom number. Vodacom contracts and any other networks are excluded.

14.2.3. R5 (five rand), R10 (ten rand) and R25 (twenty five rand) data is valid for 30 (thirty) days once data is loaded.

14.2.4. To load your data, dial *100*01* followed by the voucher pin in the voucher SMS and then #. e.g. *100*01*123456#. Your account will automatically be loaded onto your mobile number.

 

15. GRAND PRIZE - EQUIPMENT  

15.1. 10 (ten) x washing machines based on availability and at full discretion of the promoter

15.2. Rewards cannot be redeemed for cash in part or whole, and are non-refundable, non-exchangeable and non-transferable.

15.3. Rewards cannot be exchanged for an alternative Reward and the decision is final; no negotiations will be entered into.

15.4. Participants must therefore ensure that the Promoters have their correct, updated details. If the winner cannot be contacted after sending three emails and/or three phone calls on three consecutive business days, the prize will be forfeited and a redraw will take place.

15.5. Without detracting in any way from the Promotion Rules, the following general provisions shall be applicable to these Rules.

15.6. From and against any actions, claims and/or liability for injury, loss, damage, expense, claim or damages of any kind resulting in whole or in part, directly or indirectly, from participation in the Promotion, and/or the use, acceptance or possession of a Reward, and/or participation (or non-participation) in a Reward-related activity – included in this is any damage related to the delivery and installation of the reward.

15.7. Entrants who, in the Promoters’ sole determination, act unlawfully, fraudulently, in breach of these Rules or otherwise dishonestly may be disqualified from participating in the Promotion and shall not be eligible to win any Reward.

15.8. Risk and benefit will pass to the Winner upon collection of the Prize. 

15.9. The Winner will be responsible to pay all maintenance and repair costs relating to the Prize.

15.12. Winners will be selected by means of a random draw and will be notified telephonically upon which they will be required to verify their details. The promoter will endeavour to contact the prize winners once every day for 5 consecutive working days after their name is drawn and leave a voice message, if possible to do so, if the winner cannot be contacted. However, if they cannot be reached and do not return the call within 24 hours of the last voice message being left, the person/s will be disqualified.

 

16. GRAND PRIZE - Sure Voyager Travel Family Holidays

16.1. 10 (ten) x VOUCHERS FOR family holidays each to the value of R10 000 (ten thousand rand)

16.2. 1 (one) x family per holiday MAY AVAIL THEMSELVES OF THE HOLIDAY

16.3. Families can only win 1 (one) x holiday and are excluded from future draws once they have won

16.4. All bookings are to be made by the prize-winners only with Sure Voyager Travel. Bookings will only be made on receipt of a written/Email booking request, and ID / valid passport copies of all travellers.

16.5. It is up to the travellers to ensure they have the correct travel documentation, and are responsible for the costs of same.

16.6. The prize is to be used for holiday packages only – including flights, car rental, accommodation, tours, etc, and cannot be transferred to another person, and is not redeemable for cash or Foreign Exchange

16.7. Any additional expenses inclusive of but not limited to spending (entertainment, food, drinks, activities), insurance, transfers, falls outside of the stipulated prize and will be for the prize winner’s own account.

16.8. Un-used portions of the prize value are not refundable, e.g. if the package comes to R9700, then no “change” can be given.

16.9. Travel vouchers can be used for travel holidays within South Africa, regional countries, and internationally.

16.10. Once a provisional booking is made, a confirmation will be sent to the prize-winner for approval.

16.11. Once approved/confirmed by the Prize winner, should the trip be cancelled, full cancellation fees will apply according to the supplier’s terms and conditions.  All cancellations need to be made in writing by the prize-winner concerned. Cancellation fees will be subtracted from the R10 000 travel reward value.

16.12. Any changes will be subject to amendment fees, which are determined on a case-to-case basis. Amendment fees will be subtracted from the R10 000 travel reward value.

16.13. No changes permitted within 2 weeks of travel date. 

16.14. All bookings need to be made a minimum 2 weeks in advance, and are strictly subject to availability at time of booking.

16.15. The prize-winner needs to be one of the travellers in each booked holiday / travel service.

16.16. Prize-winners are able to pay in / top up their voucher amount if their desired holiday costs more than the R10 000 prize.

16.17. Prize-winners must use their voucher in one booking – no residual value may be used at another time.  What is not fully used of the voucher value in the first booking, will be forfeited.

16.18. The prize is valid for 5 months, until 31 July 2019 by which time the voucher reward ie the holiday should have been used and enjoyed. No value will be honoured past 31 July 2019. Travel must be complete by 31 July 2019. The un-used prizes are non-refundable and are not transferrable. IF UNUSED IN THIS TIME, THEY WILL BE FORFEITED 

16.19. Once a booking is requested, the prices quoted are valid for 24hrs only, and are subject to change due to availability, currency fluctuations at time of acceptance.

16.20. Sure Voyager Travel acts as an intermediary for the purpose of booking travel services.  Sure Voyager Travel will not be liable for any loss, damage, injury, death, illness, delay that may occur from third party suppliers.

16.21. Only registered travel suppliers may be used for the fulfilment of the holiday arrangements and the use of the holiday Reward voucher.  These would be the accommodations listed by the SA Tourism Grading Council.  No private accommodation will be booked unless a graded establishment.

16.22. Only registered transport suppliers will be booked as part of the holiday voucher supplier. 

16.23. The promoter reserves the right to change the mechanics of the promotion at any time. 

16.24. The participating winners must not have a criminal record. The winners must CONSENT to criminal clearance check (if required).

16.25. The winners will be notified by Unilever by electronic means at the close of the competition, and they will be required to verify their details.

16.26. The prizes are not exchangeable for cash and not transferable, unless otherwise specified herein.

16.27. The Promoter shall have the right to change or terminate the promotional competition immediately and without notice. In the event of such change or termination, all participants agree to waive any rights that they may have in respect of this promotional competition and acknowledge that they will have no recourse against the Promoter or its agents.

16.28. In the event that the prizes are not available despite the Promoter’s reasonable endeavours to procure them, the Promoter reserves the right to substitute prizes of equal value.

16.29. Neither Unilever South Africa (Pty) Ltd, their promoters, agents and distributors nor any of its associated or subsidiary companies, directors, officers, employees or agents shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant in connection with this competition or use of the prizes.

16.30. All winners will be required to sign an indemnity; failure to sign the indemnity will result in the prize being forfeited.

16.31. The Promoter’s decision is final and no correspondence will be entered into.

16.32. Participation in the competition constitutes acceptance of the promotional competition rules and entrants agree to abide by the rules.

16.33. The prize winner must undertake that he/she is in good health and is fit to take the trip and participate in all the planned activities. Any existing illnesses, injuries or chronic conditions must be disclosed to the organizers on notification of winning the prize.   

16.34. Any extension of the trip or other travel will be for the winners own cost. 

16.35. Rewards cannot be exchanged for an alternative Reward and the decision is final; no negotiations will be entered into.

16.36. The winner will forfeit the prize for failure to obtain a VISA for any reason whatsoever. Any documentation required by the Promoter to process the prize must be submitted to the Promoter within 1 month from the date when the winner was announced.

16.39. Winners will be selected by means of a random draw and will be notified telephonically upon which they will be required to verify their details. The promoter will endeavour to contact the prize winners once every day for 5 consecutive working days after their name is drawn and leave a voice message, if possible to do so, if the winner cannot be contacted. However, if they cannot be reached and do not return the call within 24 hours of the last voice message being left, the person/s will be disqualified.

 

17. GENERAL

17.2. The Promoter shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever.  Proof of sending will not be accepted as proof of receipt.  

17.3. The Promoter shall not be responsible for the failure of any technical element relating to this promotion that may result in an entry not being successfully submitted. 

17.4. Responsibility is not accepted for entries lost, damaged or delayed as a result of any network, computer or cell phone hardware or software failure of any kind.  Proof of sending will not be accepted as proof of receipt.  

17.5. The Promoter reserves the right to disqualify any claim if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data. 

17.6. No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions. 

17.7. NOTE: Any attempt to use multiple e-mail, cell phone or Facebook accounts or other tactics to enter or vote more than the stated limit may result in disqualification and all associated entries and/or votes will be void.

Entries or votes generated by script, macro, bot, commercial contest subscription, incentives or other means not sponsored by the Promoter, vote-swapping sites, voting software, entering service sites or any other automated means and entries or votes by any means that subvert the entry/voting process or do not conform to the terms or spirit of these competition rules, will void the entry/votes and may disqualify the entrant. 

17.8. The reward is not exchangeable for cash and is not transferrable.  

17.9. The Promoter reserves the right to use the images taken of the Winner for publicity purposes in any manner they deem fit, without remuneration being made payable to the Winner.  However, the Winner has the right to object to these images being used by written notification to the Promoter at 15 Nollsworth Crescent, Nollsworth Park, La Lucia, 4051 Att: Legal Department.  

17.10. The Promoter shall have the right to change or terminate the promotional competition immediately and without notice, if deemed necessary in its opinion and if circumstances arise outside of their control.  In the event of such change or termination, all participants agree to waive any rights that they have in respect of this promotional competition and acknowledge that they will have no recourse against the Promoter or its agents.  

17.11. In the event that the Reward is not available despite the Promoter’s reasonable endeavours to procure the Reward the Promoter reserves the right to substitute the Reward of equal value.  

17.12. Neither the Promoter, its agents, its associated companies, nor any directors, officers nor employees of such, shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant or the Winner.  

17.13. The judges’ decision is final and no correspondence will be entered into.

17.18. All participants in this competition release Telkom, MTN, Vodacom and Cell C from all liabilities and claims arising out of or in connection with this competition and these terms and conditions.  

17.19. The Promoter reserves the right to delete any information uploaded by a participant which the Promoter, in its absolute discretion, believes is illegal, obscene, offensive or defamatory, or infringes the intellectual property rights of a third party, or is otherwise inappropriate for a campaign designed for mass audience entertainment.   

17.20. Participants warrant that they have full rights to the images and stories that they upload and that the use of the said material shall not constitute a breach of any third party’s copyright or other intellectual property rights.
